Terms of Use
Users and visitors accessing the Telepedia Platform (https://telepedia.net) and/or Whiki Platform (whiki.online) or any respective subdomain under the Telepedia/Whiki brand agree to be bound by, and follow, these Terms of Use.
The services are operated by Telepedia Ltd (hereinafter, “the Company”) or our corporate affiliates. We are a company registered in England and Wales registration number 14025644.
By using any of our Services, you also agree to be bound by applicable third party Terms of Use. For example, for Services that access or use YouTube's API Services, you agree to be bound by the YouTube Terms of Use; for Services that access or use Steam, the Google Play App Store, or the Apple App Store, you are subject to their respective Terms of Use; etc.
We May Make Changes to this Agreement
We reserve the right at our discretion to modify, change or remove parts of this agreement as such needed for the continuation of the business and/or as priorities change. We will try and give notice wherever possible before the Agreement is changed, but this cannot always be guaranteed.
Continued use of the Service following a change in the agreement signifies that the changes have been accepted and thus, users agree to be bound by the new revision and any changes to the Agreement that this may bring. As a result, we encourage that this page is checked regularly to avoid issues.
Age Restrictions
Use or access of the Services by anyone under the age of 13 is strictly prohibited. If you are over 13, but still a minor or lack the legal capacity to enter into a contract in the territory in which you reside in, you agree that you have obtained permission from your parent or legal guardian to use the Services, and your parent or legal guardian has agreed to be bound by these Terms of Use on your behalf.
Account Registration
Creation of an account is not a requirement to access the Services provided by the Company. If you chose to register an account, however, you will be provided with a password, and a unique identifier code in the form of a username which you can use to access further Services. You must treat such information as confidential and understand that account sharing with other individuals is strictly prohibited and a violation of the Terms of Use.
You must notify the Company immediately upon breach of the security or unauthorized use of your account. The Company reserves the right to terminate your account, delete your profile, and remove any content you have submitted to the Service for any reason, or no reason, at the sole discretion of the Company without prior notice.
Privacy and Content Submissions
In using the Services, the Company may request certain information (such as email addresses etc.), which is subject to the Company Privacy Policy. Continued use of the Services signifies that the Privacy Policy has been read and understood, and that you agree to be bound by such terms within the Privacy Policy.
By using the Services, you and other users of the Service may provide information or content (hereinafter, “User Submitted Content” or “USC”), which may be visible to other users also accessing the Service. You understand that by posting information or content on the Services or otherwise providing content, materials, or information to the Company or in connection with the Services (collectively, “User Submitted Content”), the Company hereby is and shall be granted a nonexclusive, worldwide, royalty free, perpetual, irrevocable, sub-licensable and transferable right to fully exploit such USC (including all related intellectual property and proprietary rights) in connection with the Services and the Company’s business, including without limitation for promoting the Services, running advertisements, and to reproduce, modify, or prepare derivative works of, display and perform, such USC.
You further understand:
- the Company cannot (and makes no attempt to) guarantee the identity of any other users that you may encounter whilst using the Services,
- the Company cannot guarantee the validity or authenticity of any such USC that users may provide about themselves.
Restrictions
You agree that you will not submit any USC to the Service or otherwise use the Services in a manner that:
- violates the intellectual property, trademarks, or other rights of any third party,
- violates any law, statute or regulation,
- is harmful, fraudulent, threatening, abusive, harassing, defamatory, or otherwise objectionable,
- involves commercial sales wherein the user has not explicitly gained the Company’s written consent,
- impersonates any person or entity,
- attempts to maliciously crawl, scrape, spider any page provided by the Company,
- attempt to obtain the source code of the Service or any Services offered by the company for use wherein these are not freely made available and published by the Company.
Warranties and Limitations
All the materials provided by the Company are provided “as is”. The Company makes no warranties, may it be expressed or implied, therefore negates all other warranties. Furthermore, the Company does not make any representations concerning the accuracy or reliability of the use of the materials on its Services or otherwise relating to such materials or any sites linked back to the Service.
The Company or its suppliers will not be held accountable for any damages that may arise with the use or inability to use the materials provided through use of the Services, even if the Company or an authorized representative of the Company has been notified, orally or written, of the possibility of such damage. Some jurisdictions do not allow limitations on implied warranties or limitations of liability for incidental damages, these limitations may not apply to you.
To the fullest extent permitted by applicable law, the Company reserves the right, without notice and in our sole discretion, to terminate your license to use the Services (including to post USC), and to block or prevent your future access to and use of the Services, including where we reasonably consider that:
- your use of the Services violates these Terms of Use or applicable law;
- you fraudulently use or misuse the Services; or
- we are unable to continue providing the Services to you due to technical or legitimate business reasons. This includes the ability to terminate or to suspend your access to any purchased products or Services, including any subscriptions.
To the fullest extent permitted by applicable law, your only remedy with respect to any dissatisfaction with (i) the Services, (ii) any term of these Terms of Use, (iii) any policy or practice of the Company in operating the Services, or (iv) any content or information transmitted through the Services, is to terminate your account and to discontinue use of any and all parts of the Services.
